Legal Requirements
and Limitations to Infertility Treatment
Why Choose Ukraine?
In the realm of infertility treatment, Ukraine stands out as one of the few countries that fully supports and regulates surrogacy through its laws.
While many European countries have shied away from this method, Ukraine has embraced it, attracting people from around the world seeking medical tourism for fertility solutions.
For foreigners, Ukraine allows access to surrogacy programs, although it is not permitted for gay individuals or single parents.
According to the Order of the Ministry of Health of Ukraine No. 787, adults have the right to seek infertility treatment, and all infertility treatment programs are kept strictly confidential. Egg donors can either be anonymous volunteers or relatives of the female patient.
Legal Framework for Surrogate Motherhood in Ukraine
Ukrainian legislation is clear in defining the rights and responsibilities of participants in surrogacy programs.
Couples facing infertility can use surrogate mother services, and the law mandates that agencies and medical centers maintain medical confidentiality.
Throughout the surrogacy program, the quality of all medical procedures is strictly controlled by law. Spouses are provided with comprehensive information about the program, survey results, and potential risks.
The relationship between spouses and the surrogate mother is governed by a contract signed before the program commences. The contract protects the rights of all parties involved, including:
- The married couple provides monetary compensation to the surrogate mother, as specified in the contract. The surrogate mother agrees to relinquish any parental rights to the child, transferring the newborn to the parents after childbirth.
- The birth certificate promptly records the names of the biological parents without requiring any court approval.
Price and Compensation to the Surrogate Mother
Financially, surrogate motherhood in Ukraine allows for paid programs without restrictions on the amount of compensation provided to the surrogate mother.
The compensation can amount to up to €26,150, paid in parts at different stages of the program. For a married couple, the program cost is determined by the surrogate mother’s payment along with associated expenses, including examinations, IVF procedures, pregnancy management, childbirth, medications, and legal support.
Our agency offers several types of surrogacy programs, and you can find more information about the programs here.
